These Terms of Use (“Terms”) govern access to and use of the website https://www.jickie.co and any associated pages (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy below. If you do not agree, please refrain from using the Site.

1.2. Eligibility & Account

The Site is intended for adults. If you create an account, you must keep your login credentials confidential and are responsible for all activities carried out under your account. Notify us promptly of any unauthorized use at hello@jickie.co. We may suspend or terminate access in case of breach of these Terms.

1.3. Availability and Modifications

We may modify the content and features of the Site at any time and without prior notice, or suspend access for maintenance. We strive for accuracy but do not guarantee that the Site will be error‑free or uninterrupted.

1.4. Intellectual Property

All texts, visuals, logos, photographs, videos, trademarks and other content on the Site are owned by JICKIE or its licensors and are protected under French and international IP laws. Any reproduction, adaptation or public communication without prior written authorization is prohibited. You may download or print content strictly for your personal, non‑commercial use and provided you preserve all proprietary notices.

1.5. User Conduct — Prohibited Uses

You agree not to: (i) use the Site unlawfully; (ii) attempt to gain unauthorized access to the Site or its servers; (iii) introduce malware or disrupt network operations; (iv) extract or reuse substantial parts of the Site; (v) infringe third‑party rights; (vi) use the Site for advertising or solicitation without our consent.

1.6. Third‑Party Links

The Site may contain links to third‑party sites or services. We do not control them and cannot be held liable for their content, availability, or practices. Use at your own risk and review their terms and policies.

1.7. Products, Orders & Applicable Terms

Sale of products via the Site is governed by our General Terms and Conditions of Sale (CGV) available on the Site. In case of conflict between these Terms and the CGV regarding a purchase, the CGV prevail.

1.8. Liability

Within the limits permitted by law, JICKIE shall not be liable for indirect damages, loss of profit, loss of data or any prejudice resulting from (i) use or inability to use the Site; (ii) acts of third parties; (iii) events of force majeure. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law.

1.9. Governing Law — Disputes — Mediation

These Terms are governed by French law. Consumers may submit disputes to a consumer mediator: https://www.economie.gouv.fr/mediation-conso. The competent courts are those designated by applicable consumer procedural rules. You may also use the European Commission’s ODR platform: https://ec.europa.eu/consumers/odr/.

We may update these Terms from time to time. The applicable version is the one posted on the Site at the time of use. Material changes will be signalled by an updated “Last updated” date.

2) Privacy Policy (EU/FR — GDPR)

This Privacy Policy explains how JICKIE collects and processes personal data in connection with www.jickie.co (the “Site”). We comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and French law, including the Loi Informatique et Libertés.

2.2. What Data We Collect

Depending on your interactions with the Site, we may process:

  • Identification & contact data: name, email, postal address, phone.

  • Order & delivery data: products purchased, amount, order history, delivery info.

  • Payment data: last 4 digits, tokenized payment identifiers (full card data handled by PCI‑DSS certified PSPs such as Stripe; we do not store full card numbers).

  • Technical & usage data: device, browser, IP, logs, cookies/trackers, browsing events.

  • Preference & marketing data: newsletter opt‑in, communication preferences.

  • UGC & support: messages, reviews, photos you submit.

  • Professional data (B2B only, if applicable): company, role.

  • Sensitive data: not intentionally collected. Please do not send health or special category data via free‑text fields.

2.3. Purposes & Legal Bases

We process data for:

  • Contract performance (Art. 6(1)(b) GDPR): account creation, order processing, payment, delivery, customer service.

  • Legal obligations (Art. 6(1)(c)): accounting, tax and product safety obligations, response to lawful requests.

  • Legitimate interests (Art. 6(1)(f)): Site security, fraud prevention, analytics (audience measurement), improvement of services, limited direct marketing to customers (soft opt‑in, where allowed).

  • Consent (Art. 6(1)(a)): newsletter, promotional emails/SMS, non‑essential cookies/trackers, certain audience measurement/ads.

2.4. Cookies & Trackers

We use cookies and similar technologies. Non‑essential cookies are activated only after consent via our cookie banner/CMP, where you can accept, refuse, or customize settings at any time. 2.5. Recipients & Processors

Access to personal data is limited to authorized staff on a need‑to‑know basis. These providers are bound by contracts meeting GDPR requirements.

  • Orders/invoices: 10 years (legal archiving).

  • Prospects (newsletter): 3 years from last interaction or until withdrawal of consent.

  • Cookies: per vendor, typically 6–13 months for audience cookies; see Cookie Notice.

2.8. Your Rights

You have the following rights under GDPR (subject to conditions):

  • Access, rectification, erasure, restriction, portability, objection (including to marketing), and the right to withdraw consent at any time.

  • Post‑mortem directives (France) regarding the fate of your data after death.

2.9. Marketing Communications

We send promotional emails/SMS only with your prior consent (or to existing customers for similar products within legal limits). You can unsubscribe at any time via the link in our emails/SMS or by contacting hello@jickie.co. For SMS, reply STOP to opt‑out.

2.10. Security

We implement appropriate technical and organizational measures to protect data (TLS/HTTPS, access controls, least‑privilege, encrypted payments via PCI‑DSS PSPs, backups). No system is 100% secure; in case of a personal data breach, we will follow applicable notification rules.

2.11. Minors

The Site is intended for adults. In France, the digital age of consent is 15. We do not knowingly collect personal data from children under 15 without guardian consent. If you believe a child has provided data, contact hello@jickie.co to request deletion.

2.12. Changes to this Policy

We may update this Policy to reflect legal, technical, or business developments. Material changes will be announced on the Site with an updated date.

3) Mobile Messaging (SMS) Terms — EU/FR

By subscribing to JICKIE SMS, you consent to receive recurring text messages (service and/or marketing) to the mobile number you provide. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. You can opt‑out at any time by replying STOP; for help, contact hello@jickie.co. We process your number based on consent; see Privacy Policy above. Some messaging providers and carriers may process data outside the EU; transfers are subject to safeguards as described in section 2.6.
