Generale Conditions of Sale

The general conditions of sale define the conditions of access and use of the site accessible via www.jickie.co (below, the site), which the company JICKIE makes available to Internet users.

We draw the Customer's attention to the fact that the photographs illustrating our products may turn out to be slightly different from reality due to the Customer's screen settings and the lighting during the photoshoots.

In addition, as they are handmade creations, the articles may have irregularities in the finish, differences in format, which cannot be considered as defects. The responsibility of the Company cannot be questioned, and the validity of the order cannot be affected.

 

TERMS AND CONDITIONS

1. OBJECT

The “General Conditions” govern the conditions of ordering, payment, delivery and management of any returns of products ordered by customers on the site www.jickie.co.

The GCS are enforceable against the customer who declares to have read them and to have accepted them by checking the box "I accept the General Conditions of Sale" before the implementation of the online ordering procedure.

 

2. CUSTOMER

The customer of the site is the adult and a legally capable physical person having the quality of consumer.


3. PRODUCT

The characteristics of the products are presented on the site www.jickie.co inside each product sheet: the materials of the products, the dimensions...

4. ORDERS

To place an order, the customer must follow these steps:

- Make a selection of products (hair claw, headband etc)

- Finalize the order and complete the form to indicate the necessary personal data (delivery address, delivery information, etc.)

- Choose your method of payment (Via a bank or Paypal)

- Familiarize yourself with the General Conditions of Sale

- Add a promotional code if existing

- Proceed to payment

It is up to the customer to check the details of the order – in particular the total price of the order taking into account the price of the products, the delivery methods and costs, the VAT – and the accuracy of the information they communicate.

The price of each product is indicated on the website in euros, including VAT, but excluding customs fees and other taxes. Customs charges and other taxes must be paid by the customer directly to the carrier depending on the country of destination. Packaging, order processing and shipping costs are indicated before validation of the order.

Jickie reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons. In any of these cases, the customer will be informed by telephone or by e-mail.

In the event that the products presented on the site are no longer available for sale at the time your order is sent, the Company must inform you promptly, before 30 working days from the day following your order, of the possible unavailability of the product(s) ordered. In the event that you have paid for the product(s) in advance, Jickie will reimburse the full amount paid.

The contract is deemed concluded upon receipt of the order after verification of the accuracy of the data relating to the order.

Following the validation of the order, a notice of receipt will be sent by email to the customer, containing a summary of the order (essential characteristics of the product, price, means of payment, right of withdrawal, delivery times and costs).

The prices of the products may be modified at any time and without notice, in particular due to changes in the economic, legislative and fiscal framework. The products are invoiced on the basis of the tariff in force when the customer places an order.

 

5. PAYMENT

The site offers payment via various banks or Paypal. When the order is finalized, Jickie confirms the payment by sending the customer a summary email.

The prices displayed on the site are expressed in euros, all taxes included (French VAT and other taxes applicable on the day of the order).

Payment for purchases is made via the secure platform of our partner PayPlug, Paypal.

For delivery outside the European Union, the customer must pay customs duties or other taxes due when the products are imported into the country of the place of delivery. The related formalities are also the sole responsibility of the customer. The customer is solely responsible for checking the possibilities of importing the products ordered with regard to the rights of the territory of the country of delivery.

 

6. DELIVERY

The products are delivered according to the shipping method chosen by the customer to the delivery address indicated on the order form.

Our products are delivered worldwide. No delivery can be made to a hotel address.

Any change of delivery address made by the customer after the registration of the order may result in an extension of the delivery time.

The customer has the possibility of obtaining the cancellation of the order under the conditions provided for in article L 216-2 of the Consumer Code, that is to say by registered letter with acknowledgment of receipt, after having ordered the Company to make the delivery within a reasonable time by registered letter with acknowledgment of receipt, without the Company having complied.

 

7. RECEIPT OF PRODUCTS

Upon receipt of the product, the customer must immediately check, in the presence of the carrier, the condition of the packaging and the product delivered.

If the packaging is damaged, torn or opened, the customer must check the condition of the products it contains. If these products have been damaged, the customer must imperatively refuse the package and note a reservation on the delivery slip: damage, missing item, damaged package, broken item, etc. This verification is deemed to have been carried out when the customer, or a person authorized by him, has signed the delivery note.

The customer must then confirm by registered mail his reservations to the carrier no later than three days, not including public holidays, following that of receipt of the products and send a copy of this letter to the Company CHEMS PARIS.

Failure to comply with said deadline does not affect the recourse that the customer may have to obtain the exchange or reimbursement of the products. Similarly, the customer always benefits from his right of withdrawal under the conditions of article 9 "Right of withdrawal" above.

 

8.      GUARANTEES 

All items for sale on www.jickie.co have a 3-month warranty from the date of delivery of the order.

When the customer buys a product, he benefits from legal and commercial guarantees under the conditions provided for respectively by articles L 217-4 and following of the Consumer Code and 1641 and following of the Civil Code. The warranty applies only in cases where there is a manufacturing defect, and in the case where the damage to the product has not been caused by improper use of it.

The Company will study in detail the reason for the damage in each case. To request the execution of the guarantee, the customer must write to customer@jickie.co

 

8.1 Legal guarantee of conformity

The legal guarantee of conformity concerns all defects of conformity already existing on the date of delivery of the product. For example, if the product delivered does not correspond to the description (color, dimensions, materials) or if the product does not function according to the expected use. The customer has a period of 2 years from the delivery of the property to play it. He will thus be required to choose between the repair and the replacement of the good.

If these 2 options are impossible – for example if the manufacture of the product has been stopped – or cannot be implemented within the month following the complaint, the customer can be reimbursed in full (by returning the product) or partially (by keeping the product).

8.2 Legal warranty against hidden defects

This warranty protects the consumer against hidden product defects. The customer has a period of 2 years from the discovery of the hidden defect to implement it.

Two solutions are possible:

- the customer keeps the product and asks for a price reduction
- the customer returns the product and requests reimbursement of the price paid as well as the costs incurred by the sale.

     

    9. CLIENT'S RIGHT OF WITHDRAWAL

    The customer has a period of 14 days to change his mind about his purchase. The right of withdrawal also applies if the product is on sale, second-hand or destocked.

    The right of withdrawal can be exercised from:

    – the finalization of the order;

    – the reception of the articles.

    Before the expiry of this 14-day period, the customer must inform customer service of his decision to withdraw by sending him the standard withdrawal form (provided with the contract) or another written document clearly expressing his desire to withdraw and mentioning the order number to: customer@jickie.co

    The customer must return the product at his own expense to the address mentioned on the withdrawal form no later than 14 days following the communication of his decision to withdraw.

    In the event of the return of part of an order, the seller will reimburse the delivery costs in proportion to the number of items returned, except in the case of fixed delivery costs.

    The Company must reimburse the customer, including the delivery costs, at the latest within 14 days from the date on which it has actually collected the product or from the date on which the customer has provided it with proof of shipment of the product.

    Reimbursement will be made by bank transfer to the card used to pay the initial invoice.

    It is not possible to replace or exchange returned products. You will need to place a new order online.

    For returns of personalized products: Article L 121-20-2 of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized. However, we undertake to reimburse you for clearly personalized products that do not correspond to your order (defective or non-compliant).

     

    10. RETURNS & EXCHANGES

    Trades

    The conditions for requesting an item exchange are as follows:

    – products damaged upon receipt;

    – the product does not meet expectations.

    All products returned for exchange must be in perfect condition and without obvious signs of use. Otherwise, JICKIE will not be able to proceed with an exchange.

    The customer is responsible for providing the correct packaging to ensure that all items arrive at their destination in perfect condition (the original small cardboard box – received with the initial order – can be reused).

    Exchanges are accepted up to 14 days after receipt of the shipping confirmation email.

    To exchange the items ordered, the customer must download the return form in the "returns" section at the bottom of the website page.

    Once the declaration of exchange has been approved by customer service, a new item will be sent back and the customer must return the product to be exchanged in return.

    For international exchanges, our customer service will inform you of the procedure and conditions to be followed.

    JICKIE will refuse returns/exchanges of personalized models.

     

    Returns

    After approval of a return, the item must be returned to the address indicated. The customer must fill in the exchange and return form and include it in the package to be returned.

    Upon receipt, the customer will receive a confirmation email indicating the amount refunded within 2 to 3 working days.

    The refund of the amount due will be made by bank transfer or according to the original purchase method.

    Exchanges are accepted up to 14 days after receipt of the order.

    All costs associated with the exchange of the product will be at the buyer's expense.

    For international exchanges, JICKIE will inform the customer of the procedure to follow and the corresponding cost.

     

    10. EFFECT OF THE CONTRACT

    The contract produces all its effects as soon as it is concluded and cannot be terminated unilaterally by either party, unless the customer uses his right of withdrawal under the conditions set out in articles L 221-18 et seq. Consumer Code.



    11. SETTLEMENT OF DISPUTES

    In the event of a dispute, the customer must first contact Customer Service by email: customer@jickie.co

    In the absence of a solution within 21 days of his request, the customer may contact the Joint Commission for Mediation of Direct Selling free of charge in writing (mail or email addressed to info@cpmvd.fr) with all the documents useful to the understanding of the file: explanatory and supporting documents, order form, credit agreement, letters exchanged with the professional, etc.

     

    12. APPLICABLE LAW AND JURISDICTION

    The general conditions of sale are subject to French law. In accordance with consumer law, in the absence of an amicable agreement, all disputes to which the GCS could give rise, concerning its validity, its interpretation, its execution, its termination, their consequences and their consequences will be submitted to the competent court in accordance with the common law rules of jurisdiction.
